Recently, the U.S. Environmental Protection Agency (EPA) and Army Corps (Corps) announced their intent to revise the definition of “Waters of the United States.” This is a critical issue to small business property owners and could dramatically upend your ability to develop land without expensive and time-consuming EPA permits.

In 2015, when the Obama Administration last tried a dramatic expansion of WOTUS, NFIB fought back with successful litigation and a campaign to show policymakers how the WOTUS rule would be devastating to small business owners around the country. Our grassroots effort helped lead to the Trump Administration dramatically scaling back years of EPA and Corp overreach. Unfortunately, this successful effort is now under threat.
